The complaint is based on Mr. Wernee’s claims as stated in a sworn affidavit collected on behalf of PCATI by Attorney Iyad Misk

The complainant raised the above claims during a hearing on the extension of his detention and the military judge who presided at the hearing ordered their investigation. However, no investigation was initiated until PCATI’s Executive Director, Hannah Friedman, wrote an urgent pre-petition letter concerning this matter.

A forensic investigation of the sexual assault was carried out following Attorney Elkhatib-Ayoub’s initiative and following a difficult struggle to receive the necessary
permits and authorizations. As a result, the examination was made at a late date in spite of the fact that this sort of examination should have been undertaken as the earliest possible time following the event.

The Police Investigations Department was responsible for dealing with this matter
at the appropriate time but, as stated above, neglected to do so. The complainant was released to his home
